Mediation
The
tendency when talking about mediation is to talk about
individuals who are in conflict with a business, an agency
or another individual. But have you ever considered that
mediation can literally save you countless thousands of
dollars in wasted legal fees where, for example, by a
small amendment to your company practice, you could introduce
mediation as the agreed manner to resolve disputes such
as sexual harassment, suspected theft, improper behavior,
and other breeches of rules.
We
know of very few people or organizations that actually
like to go to court to vent their grievances. With surprisingly
little effort, the most complex and seemingly insoluble
problems can be resolved on a basis, which is fair, inexpensive
and dignified.
Many major organizations recognize that internally and
where they meet the public, more is to be gained by attempting
to "resolve problems", by being prepared to
meet and participate in a settlement than by being confrontational.
The R.P. Baker Foundation recognizes that traditional
approaches to the resolution of disputes have proven to
be too costly and too time consuming in many situations,
particularly in those situations involving close family
or business relationships. In many of these cases, litigation
is simply not the answer and an alternative means of resolving
the dispute is required.
Mediation has been developed as distinct alternatives
to a litigated resolution of a dispute.
Mediation is essentially the involvement of a neutral
and impartial third party facilitator (Mediator) to assist
the parties to a dispute in negotiating a solution acceptable
to all concerned. This often can be a win win solution.
Mediation is emerging as viable alternatives to dispute
resolution in all areas, but particularly in situations
involving ongoing relationships such as:

Partnership or Shareholder arrangements;
· Commercial Lease arrangements;
·
Dispute arising following the death of a family member;
· Matrimonial disputes,
particularly custody and property matters.
·
Disputes between management and employees
·
Difficulties within a family owned business
·
Disputed property lines between neighbors
·
Disputes arising from costs of work i.e. construction,
auto repair
